Query by J F: Is it legal or illegal to ask for Very first AND Final Month’s rent, plus a security deposit on COMMERCIAL property?
I know the law for RESIDENTIAL leases you Can’t ask/demand a 1st AND Final month’s rent plus security deposit. Even so, in the case of COMMERCIAL rentals, I am unsure. They are two separate laws.

Depends on the state–it is legal for residences where I reside and have lived for 40 years. For commercial properties in some states they can even demand the renter post a bond for a portion of the lease.

I am interested in purchasing commercial property in a particular neighborhood in Dallas. How do I go about locating out which locations are zoned for commercial development and what type of commercial development is permitted? (For instance – restaurant/bars). I have been warned about expressing interest in a certain location too early as it creates “buzz” which can lead elevated cost and even losing the deal.

Also, is there a database for ranking commercial Realtors? (For instance, you can look up the history of lawyers and see their rank and past indiscretions.)

The city of Dallas will have a property map showing the zoning for all properties in the city. You can give them a distinct address and they will give you the zoning recommendations for that property.

The National Association of REALTORS (NAR) has a site with all the REALTORS and if they have been the topic of any indiscretions. They won’t have any public listing of earnings ranking etc. simply because that is against privacy laws.

what qualifies a property as ‘commercial’??

the taxes for our entire property is only $ 550 but now they want an extra $ 330 for the ‘commercial property’ (our 1 car garage) my husband is a self employed roofer and keeps the tools in the garage but does that qualify it as ‘commercial property’ ???
I dont know, I never saw or spoke to an assessor. We’ve never claimed it as any kind of deduction, its just our garage.

how did the Assessor come to assess the garage as “commercial”. They would have had to have some reason. Did you ever claim the garage as a deduction on your income taxes for business purposes. We need more info from you. The Assessor wouldn’t just out of the blue claim a garage as commercial, unless they had a good reason.

No money will be exchanged and I will continue to pay bills, rates, etc. Can I do this, or is it only legal when it is carried out via camelot, adhoc. Property gurdian firms.

only difficulty i see is it is probably not zoned residential if it’s commercial property. probably not to code as a residence. if so, you ought to have no difficulty.
